Mary Youssi of Walny Legal Discusses Home Sales and Elder Law on TMJ4’s The Morning Blend

Mary Youssi, an attorney specializing in Elder and Special Needs Law, Probate, and Estate and Trust Administration at Walny Legal Group, appeared on TMJ4’s The Morning Blend to discuss how families can navigate selling a senior’s home during crisis situations. The conversation addressed the legal complexities that arise when downsizing or relocation becomes necessary, particularly when decisions must be made quickly.

Youssi noted that elder law attorneys see many different categories of people facing home sale issues. Some families are already in probate processes when the decision to sell finally comes. Others include adult children reaching out on behalf of aging parents, seniors themselves seeking guidance, or spouses who didn’t handle finances during marriage and now face unexpected responsibility for both long-term care decisions and property sales.

The initial step, according to Youssi, is understanding who has authority to actually sell the property. “Let’s take it one step at a time. Let’s try to start from who has authority here to actually sell this property? Do we actually need to sell it? And if we do, like, what are the steps?” Youssi explained. “Let’s not get ahead and get too scared. We try to calm everyone down and say like, we can do this one step at a time.”

Avoiding Probate Through Planning

Youssi emphasized that there are several ways to avoid probate for a home. The key is planning ahead rather than waiting until crisis strikes. Estate planning is central to this approach, answering critical questions: Where are assets now? Where do you want them to go when you pass?

Medicaid Asset Protection Planning

Even in crisis situations, there may be options to preserve a home. Youssi discussed Medicaid asset protection planning that can apply whether someone is single or married. “There may be a way to preserve a homestead property, whether it’s the one you live in now, the big family home, or if it’s the downsized condo you live in. There are things we can do to help preserve that.”

Revocable Trusts and Estate Planning

Youssi recommended creating a revocable trust to avoid the probate process, which is public and costly. “It’s better to put your time, your money ahead of time into the estate planning part to avoid it for sure.”

Planning Ahead is Critical

The overarching message: planning should happen before a crisis forces quick decisions. “I do recommend planning ahead, getting something like a revocable trust, for example, to try to avoid that probate process,” Youssi said. “It’s never too late to try or to reach out to an attorney.”
